We have already seen the case field before ICJ by South Africa to prevent genocide happening in Gaza and hold Israel accountable.
ICJ’s ruling against Israel
ICJ has not called for ceasing the military operations like that in Russia, Ukraine war. However it indicated six provisional measures.
- Israel and its military should take measure to prevent commission of genocide.
- Also to prevent any public incitement to commit genocide.
- Ensure humanitarian assistance to Gaza people.
- Prevent any destruction of reports or evidence related to genocide in Gaza.
- Report to ICJ on the steps taken on all these provisional measures.
- All stakeholders involved in Gaza strip are bound by international humanitarian law.
Future of the ruling
- Ruling has little impact on Israel.
- Remedy for violation of ICJ rulings rests with the UNSC decisions. Decisions should be taken on consensus. Israel is a natural ally of the USA, hence, no adverse measures can be taken against Israel for its violations of ICJ ruling.
Momentous decision taken by ICJ
This acts as warning call for not only to Israel but also to other powers who are in hot pursuit who often use dehumanizing paths to deal with its opponents.
